1. Introduction

These Terms of Service ("Terms") govern your use of Picalyze ("Service"), an AI-powered photo intelligence platform operated by Jonas Rohde ("we", "us", "our"). By accessing or using our Service, you agree to be bound by these Terms.

Please read these Terms carefully. If you do not agree with these Terms, you may not use the Service.

2. Service Description

Picalyze provides:

• Photo Analysis: AI-powered analysis of photographs including composition, style, and technical quality
• EXIF Processing: Extraction and analysis of photo metadata
• Statistics Dashboard: Aggregated insights about your photography patterns
• Cloud Integration: Connection to external photo storage services (Dropbox, Google Photos, etc.)

3. Account Registration

To use Picalyze, you must:

• Be at least 16 years of age
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized account access

You are responsible for all activities that occur under your account. We reserve the right to suspend or terminate accounts that violate these Terms.

4. User Obligations

When using Picalyze, you agree to:

• Use the Service only for lawful purposes and in accordance with these Terms
• Not upload content that infringes intellectual property rights or violates applicable laws
• Not attempt to circumvent security measures or access unauthorized areas of the Service
• Not use automated systems or bots to access the Service without our express permission
• Not interfere with or disrupt the Service or its servers

5. Intellectual Property

Your Content

You retain all rights to the photos and content you upload to Picalyze. By uploading content, you grant us a limited license to process, analyze, and store your content solely for the purpose of providing the Service to you.

Our Service

The Picalyze platform, including its design, features, code, and documentation, is owned by us and protected by intellectual property laws. You may not copy, modify, or create derivative works from our Service without our written permission.

6. Subscription and Payment

Picalyze offers both free and paid subscription tiers. For paid subscriptions:

• Payments are processed securely through Stripe
• Subscriptions automatically renew unless cancelled before the renewal date
• Prices may change with 30 days' notice to existing subscribers
• Refunds are handled in accordance with applicable law (see Section 7 for withdrawal rights)

7. Right of Withdrawal (Widerrufsrecht)

The withdrawal period expires 14 days from the day of the conclusion of the contract. To exercise your right of withdrawal, you must inform us of your decision to withdraw by a clear statement (e.g., a letter sent by post or email).

You may use the following withdrawal form, but it is not obligatory:

Effects of withdrawal: If you withdraw from this contract, we shall reimburse you all payments received from you, without undue delay and in any event not later than 14 days from the day on which we are informed about your decision to withdraw.

Exception: If you requested that the services begin during the withdrawal period, you shall pay us an amount proportional to what has been provided until you communicated your withdrawal.

To the maximum extent permitted by applicable law:

• We provide the Service "as is" without warranties of any kind
• We are not liable for indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid us in the 12 months preceding the claim
• We are not liable for data loss caused by circumstances beyond our reasonable control

These limitations do not apply to liability for intentional misconduct, gross negligence, or liability that cannot be excluded under applicable law.

By You: You may terminate your account at any time through your account settings or by contacting us. Upon termination, your data will be deleted in accordance with our Privacy Policy.

By Us: We may suspend or terminate your account if you violate these Terms or engage in conduct that harms us or other users. We will provide reasonable notice unless immediate action is required.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or through a notice on our website at least 30 days before they take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany. For consumers residing in the EU, mandatory consumer protection laws of your country of residence shall apply where they provide greater protection.

Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Germany, unless mandatory law provides otherwise for consumers.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
